Community Property Agreement

We will prepare a community property agreement for spouses to execute for the purposes of ensuring that all of their property is community property. This can help avoid probate if the first spouse to die wishes the surviving spouse to have all of the couples’ assets. The service price is for a blanket community property agreement suitable for recording in Washington or Idaho. If certain assets are to be exempted from the community property agreement, an additional drafting fee applies; contact us for a custom quote. The community property agreement should be recorded in any county in which the couple owns real estate that will be affected by the community property agreement. The cost of recording fees charged by the county is not included in the service price. Included in the price is notary service in our office and mailing the original and a copy for recording in one Washington or Idaho county. Recording in additional counties or same-day recording are available at an additional charge.
