A deed is a document that conveys, or transfers, title in real property to another. It must meet all legal requirements and must be notarized. Additional requirements for transferring real property apply depending upon the location of the property.

Gifts of real property are common. A deed that meets all legal requirements must be used. In Washington state, the transfer may be subject to real estate excise tax depending upon the circumstances. Lucent Law evaluates and consults with our client about the potential tax consequences of each deed transfer we handle.

Lucent Law’s deed packages are not intended to be used to complete sales. Our deed packages are for things like adding or removing someone from title, gifting property, or adding property to a trust or LLC where no money is changing hands. Sales are much more complicated transactions. We recommend that sales only happen under the terms of a written purchase and sale agreement, and that the deed to complete the sale be prepared and recorded by an attorney or escrow agent as part of a closing. Lucent Law offers both purchase and sale agreement packages and real estate closing services.  

Lucent Law offers free notary services with all of our deed packages in our two conveniently located Spokane offices. We can arrange for mobile notary services to come to your home or workplace for an additional fee (subject to availability).

Lucent Law includes a recording service (electronic where available) with all of our deed packages. We’ve recorded thousands of deeds and we know all of the technical requirements to prevent rejection by the recorder’s office. We’ve found that our clients are better served where we handle the recording of the deed and the filing of the Real Estate Excise Tax Affidavit (in Washington).

Deed Preparation Package

The experienced real estate law team at Lucent Law, PLLC will prepare and record a deed and will file the required Real Estate Excise Tax Affidavit for Washington properties. This package also features:

  • Excise Tax Review (for Washington properties)
  • Deed Selection Review (to determine if a Quit Claim Deed or Statutory Warranty Deed (WA) or Warranty Deed (ID) should be used
  • Review last vesting deed
  • Preparation of deed in required form within two business days after we have received and reviewed the last vesting deed and have received your completed Deed Questionnaire

Single Owner LLC Package

The experienced business law team of Lucent Law, PLLC will form your new single owner Washington limited liability company by preparing and filing a Certificate of Formation and the required Initial Annual Report. This package also features:
